Terms & Conditions. *
The following definitions apply in this agreement:
Building: 147 Stoke Newington High Street London N16 0NY
Garden Permitted Hours:10.00 to 19.00.
Property Permitted Hours:09.00 to 22.00
Permitted Use: A use within Use Class E of the Town and Country Planning (Use Classes) Order 1987 as amended by the Town and Country Planning (Use Classes) (Amendment) (England) Regulations 2020.
Property: the ground and basement floors of the Building shown for identification only on the plan attached to this agreement and the Garden Area.
Garden Area: the garden at the rear
Rent: (Non refundable)
Cleaning: £90 + vat
Deposit: £750

The Landlord lets and the Tenant takes the Property on a tenancy dated
The Landlord and the Tenant acknowledge that this agreement creates a tenancy at will terminable at any time by either of them, notwithstanding that the Rent is calculated and payable by reference to a period and that the Landlord intends to demand the Rent, and that the Tenant has agreed to pay the Rent, by reference to that period.

The Tenant shall pay the Rent and any value-added tax in respect of it and without any deduction, set off or counterclaim monthly in advance from the date of this agreement.
The Tenant shall not:
use the Property otherwise than for the Permitted Use and shall keep it open during the Property Hours and in respect of the Garden Area, this shall not be used outside of the Garden Permitted Hours;
assign, underlet, charge, part with or share possession of, or otherwise dispose of the Property or any part of it or any interest in it;
share occupation of the Property or any part of it;
smoke in any part of the Building;
make any alteration or addition whatsoever to the Property nor fix anything to the walls floors or ceilings without the Landlord’s consent which can be withheld in its absolute discretion;
put any signs at the Property; or
cause any nuisance or annoyance nor any anti-social behaviour to the Landlord or to any owners or occupiers of the Building or of neighbouring property.
The Tenant shall keep the Property clean and tidy and make good any damage it causes to the Property and to any plants planters walls pergolas shed fences or other items in the Garden Area.
The Tenant shall keep cleansed and free from obstruction all sewers, drains, sanitary apparatus, water and waste pipes, air vents and ducts within and serving the Property
The Tenant shall dispose of any rubbish and recycling from the Property regularly and in accordance with the rules of the London Borough of Hackney
The Tenant shall act at all times in a reasonable and responsible manner and in accordance with any regulations that may be made by the Landlord from time to time.
The Tenant shall be responsible for Hackney waste and recycling charges
The Tenant shall pass on any notices or other correspondence received at the Property and addressed to the Landlord or relevant to the Landlord’s interest in the Property (or the Building).
The Tenant shall allow the Landlord (and all others authorised by the Landlord) to enter the Property at any reasonable time for the purpose of ascertaining whether the terms of this agreement are being complied with and for any other purposes connected with the Landlord’s interest in the Property (or the Building).
When the Tenant vacates the Property at the termination of the tenancy created by this agreement, it shall remove all furniture (and other items belonging to it) and shall clear all rubbish from the Property and leave it in the condition and state of repair required by this tenancy at will.

The Landlord shall allow the Tenant (and its employees and visitors) access to and egress from the Property over the common parts of the Building.
The Landlord shall use its reasonable endeavours to ensure that there is a supply of electricity, and water to the Property, at such times of the day as the Landlord considers appropriate.

The Tenant shall allow Guardian Security or such other security company appointed by the Landlord from time to time access to the Property at all times including ensuring the premises are vacated by 22.00 hrs
The Tenant will keep the Property secure outside of business hours or when otherwise unoccupied by closing the shop shutters and setting the burglar and fire alarms.
The Tenant shall not use nor permit the Property to be used for any unlawful use and must comply with all laws in its use.
The Tenant shall not bring, use and/or store any flammable substances, incl candles and fireworks, on the Property or in the Building.
The Tenant must not wedge open any doors at the Property or in the Building.
The Tenant shall indemnify the Landlord against any costs (including legal or other professional fees) claims or demands arising directly or indirectly from a breach by the Tenant of the terms of this tenancy at will.
The Tenant must arrange and keep public liability insurance with a minimum £5 million cover in respect of the Property such policy to be approved by the Landlord and shall provide to the Landlord on demand a copy of the policy of insurance.
The Tenant shall notify the Landlord immediately of any damage, leaks, faulty services incl broadband, water, electricity, gas, CCTV, burglar and fire alarm or loss of keys by tel (020 3903 6517) and email hello@stokeypopup.com or to City Heritage Ltd, the landlord’s agent.

The Landlord may but has no obligation to provide broadband or Wi-Fi for the use of the Tenant and shall have no responsibility for any periods during which such services are not provided.

7.1. Tenant cancellation
7.1.1. The Tenant can Cancel anytime
7.1.2. Deposit and cleaning refundable
7.1.3. Rent and business rates are non-refundable
7.2. Landlord cancellation
7.2.1. The landlord can cancel at any time with a full refund.
7.2.2. the landlord does not accept any responsibility for damages and/or loss of earnings

1. Smoking
Smoking is not permitted anywhere inside the premises, building and/or garden.
2. Alcohol
2.1. Guests are not permitted to bring alcohol onto the premises, including the garden.
2.2. The tenant may provide alcohol free of charge to guests.
2.3. As the premises are unlicensed, alcohol cannot be sold unless the tenant obtains a Temporary Event Notice (TEN).
2.4. The landlord may, at their discretion, permit temporary events on the premises, provided a TEN is obtained from the London Borough of Hackney.
2.5. Obtaining and covering the cost of a TEN is the tenant’s responsibility, subject to prior written consent from the landlord.
3. Keys.
Keys must be collected as advised by the landlord and returned to the premises or to our cleaners by 10:00 hrs the following morning (excluding Saturdays, Sundays, and bank holidays) or another time and place, as per the landlord’s written convenience and instruction
4. De-humidifiersIf the landlord requires, the tenant must ensure de-humidifiers remain operational.
5. Capacity
The maximum capacity of the premises is 120 people, including guests and staff, in compliance with fire regulations. This includes a limit of 60 people on each floor (basement and ground floor/garden) at any given time.
6.Keys.
6.1. One set of keys will be provided to the tenant.
6.2. Banham offers a keyholding service for lost or stolen keys.
6.3. Contact Banham for assistance at a fee of £100 + VAT, payable directly to the landlord. Available 24/7.

6.4. Replacement keys will incur an admin fee of £250 + VAT, plus the cost of the keys.
7. Waste.
7.1. Two waste sacks and two recycling sacks are included per week. Additional waste disposal must be arranged and paid for by the tenant via the London Borough of Hackney.

8.1. The tenant is responsible for all damages, repairs, and maintenance.
8.2. No music/sound is to be played that can be heard outside the premises and/or garden.
8.3. The PA system includes a sound limiter to ensure that sound cannot be heard outside the premises, including the garden.
8.4. Altering or relocating the system is not permitted.
9. Utilities
9.1. All issues (e.g., damages, leaks, or faults with broadband, water, electricity, gas, CCTV, or alarms) must be reported immediately to City Heritage Ltd, the landlord’s agent, at:

9.2. The landlord is not liable for any malfunctions or maintenance of utilities and/or systems (e.g., PA system, water, electricity, lighting, toilets, security systems, etc.), damage to property, or any injuries/deaths.
10. Garden
10.1. Music, food, drinks and their preparation and their consumption are prohibited in the garden.
10.2. No music and/or sound is to be played or made that can be heard outside the garden and/or premises
11. Locks and shop shutter
11.1. Locks for the shop internally and externally or shutter are not be changed by the tenant.
11.2. The tenant is responsible for securing the premises, including setting the burglar alarm, double-locking the shop and garden doors, and closing the front shutter.
12. Burglar alarm
12.1. The burglar alarm code is 1918.
13. Fire alarm
13.1 The tenant is to ask the check in clerk how to reset the fire alarm
14. Contents insurance
14.1. Tenants are to arrange contents insurance for their belongings, materials, products, paintings, electronics etc
14.2. The landlord is not liable for theft and/or damage of tenant’s belongings, materials, products, paintings, electronics etc (e.g., electronics, materials, phones, keys etc).
15. Events security.
Any event with 20 or more attendees after 17.00 hrs requires security services provided by Guardians Security Solutions Ltd, at the tenant’s expense (£25 + VAT per hour, minimum 5 hours) or another certified & insured security that is approved in writing by the landlord.
16. Check in condition.
The check in & out clerk will check out the premises against the check in inventory and photograph report.
